Welcome to Worksona. These Terms of Service ("Terms") govern your access to and use of Worksona's websites, applications, profiles, AI features, and related services (collectively, the "Service").

The Service is operated by Worksona LLC ("Worksona," "we," "us," or "our"). By creating an account, accessing the Service, publishing a Worksona profile, submitting content, or using any Worksona feature, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

1. What Worksona Does

Worksona helps users create interactive professional profiles that can include career information, photos, social links, endorsements, AI-generated content, and an AI chat assistant that responds to visitors based on the profile information provided by the user.

Worksona is not a background-checking service, employment agency, recruiter, credential verification service, hiring platform, or professional reference verification service. We do not verify the accuracy of user profiles, resumes, endorsements, employment history, education, qualifications, or AI-generated responses.

2. Eligibility

You must be at least 18 years old to use Worksona.

By using the Service, you represent that:

  • You are at least 18 years old.
  • You have the legal authority to agree to these Terms.
  • You will use the Service only in compliance with applicable laws.
  • The information you provide to Worksona is accurate and does not violate the rights of others.

3. Accounts

You may need to create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate account information and to keep that information up to date.

We may suspend or terminate your account if we believe you have violated these Terms, created risk for Worksona or others, used the Service unlawfully, or misused the Service.

4. Your Content

"User Content" means any content, information, files, images, text, resumes, career history, profile information, links, photos, captions, endorsements, success stories, visitor messages, or other materials submitted, uploaded, generated, displayed, or otherwise made available through the Service.

You retain ownership of your User Content. However, by submitting User Content to Worksona, you grant Worksona a non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, modify, format, create derivative works from, distribute, and otherwise use your User Content as reasonably necessary to operate, improve, secure, and provide the Service.

This license includes the right to:

  • Display your published profile and related content to visitors.
  • Process your resume, career information, and other content to generate AI outputs.
  • Provide an AI chat assistant that responds based on your profile information.
  • Store and display visitor chat transcripts to you.
  • Display approved endorsements and public profile content.
  • Troubleshoot, secure, analyze, and improve the Service.

You are responsible for your User Content. You represent and warrant that:

  • You own your User Content or have the rights and permissions needed to use and share it.
  • Your User Content is accurate to the best of your knowledge.
  • Your User Content does not infringe, misappropriate, or violate the rights of any person or entity.
  • Your User Content does not violate these Terms or our Content Policy.
  • You have permission to upload or display photos, endorsements, names, logos, links, testimonials, or other third-party content.

5. Public Profiles

Worksona profiles are private by default until you choose to publish them. Once you publish a profile, certain profile information may be publicly visible to anyone with access to the relevant URL.

Public profile content may include your name, profile photo, bio, career entries, abilities, interests, social links, approved endorsements, photo gallery, captions, common questions, profile theme, and AI chat assistant.

Your raw uploaded resume is not intended to be publicly displayed, but information from your resume may be used to generate profile content, career summaries, AI responses, common questions, abilities, and other Service features.

You are responsible for reviewing your profile before publishing it.

6. AI Features

Worksona uses artificial intelligence features to help generate, summarize, classify, and respond to information based on content you provide.

AI outputs may be inaccurate, incomplete, outdated, misleading, or inappropriate. You are responsible for reviewing, editing, approving, and deciding whether to publish AI-generated content.

Worksona does not guarantee that AI-generated content is accurate, complete, lawful, appropriate, or suitable for any particular purpose.

You agree not to rely on AI outputs as professional, legal, financial, employment, hiring, or other expert advice.

You also agree that Worksona may send relevant User Content, visitor messages, profile information, resume text, career data, endorsements, interests, abilities, success stories, job descriptions, and related information to third-party AI service providers, including OpenAI and Anthropic, as necessary to provide AI features.

7. Visitor Chat

Published Worksona profiles may include an AI chat assistant. Visitors may submit messages, questions, names, company names, or other information through the chat experience.

Worksona may store visitor chat transcripts so that profile owners can review interactions with their profiles. Chat transcripts may include visitor-submitted messages and optional visitor-provided name or company information.

Profile owners are responsible for how they use information from visitor chats.

Visitors should not submit sensitive, confidential, proprietary, or unlawful information through Worksona chat.

8. Endorsements

Worksona may allow visitors or third parties to submit endorsements for a user's profile.

On Worksona, endorsements are professional recommendations from people who have worked with, managed, hired, advised, mentored, collaborated with, or otherwise professionally interacted with the profile owner.

Endorsements are not product reviews, ratings, background checks, employment verification, credential verification, or formal references verified by Worksona.

Endorsements are not verified by Worksona. Worksona does not confirm the identity, employer, title, relationship, authority, or truthfulness of any person submitting an endorsement.

Profile owners are responsible for approving only endorsements they reasonably believe are genuine, truthful, authorized, and not misleading.

You may not submit, approve, display, solicit, buy, sell, or otherwise use fake, misleading, AI-generated, undisclosed paid, unauthorized, or deceptive endorsements.

An endorsement from a person associated with a company does not mean the company itself endorses the profile owner unless clearly stated by an authorized representative.

Worksona may remove endorsements at any time if we believe they violate these Terms, our Endorsement Policy, applicable law, or the rights of others.

9. Photos and Other Uploaded Content

You may only upload photos, images, files, or other content that you own or have permission to use.

You may not upload images or files that are unlawful, explicit, harassing, hateful, infringing, misleading, impersonating, invasive of privacy, or otherwise harmful.

You may not upload images of another person unless you have permission to do so.

Worksona may remove uploaded content at any time if we believe it violates these Terms, our Content Policy, applicable law, or the rights of others.

10. Acceptable Use

You agree not to use Worksona to:

  • Violate any law or regulation.
  • Impersonate another person or misrepresent your identity, credentials, experience, education, employment history, or qualifications.
  • Upload false, misleading, fake, or deceptive professional information.
  • Submit or approve fake endorsements.
  • Infringe copyrights, trademarks, privacy rights, publicity rights, or other rights.
  • Upload malware, malicious code, spam, or harmful content.
  • Harass, threaten, abuse, defame, or target others.
  • Upload explicit, hateful, violent, discriminatory, or illegal content.
  • Scrape, crawl, copy, or harvest data from the Service without permission.
  • Reverse engineer or interfere with the Service.
  • Attempt to bypass rate limits, security controls, authentication, payment gates, or access restrictions.
  • Use the Service to build a competing product through unauthorized copying or data extraction.
  • Use AI features to generate unlawful, misleading, infringing, or harmful content.

11. Subscriptions, Billing, and Growth Plan

Worksona may offer free and paid plans, including the Growth plan.

Paid plans may unlock additional features, which may include expanded AI functionality, additional profile sections, custom bio features, social links, photo galleries, endorsement collection, custom profile URLs, private links, templates, increased AI chat capacity, and other features described at checkout or in the product.

Payments are processed by Stripe or another third-party payment provider. By purchasing a paid plan, you authorize us and our payment processor to charge the applicable fees, taxes, and recurring subscription amounts.

Subscriptions automatically renew unless canceled before the renewal date. You can manage or cancel your subscription through the billing portal or other cancellation flow made available by Worksona.

Unless otherwise required by law, payments are non-refundable. If you cancel, you will generally retain access to paid features through the end of the then-current billing period.

We may change plan names, features, prices, limits, or availability from time to time. Any material changes to paid subscriptions will be handled in accordance with applicable law and payment processor requirements.

AI chat features, including visitor chat on published profiles, are subject to reasonable usage limits, rate limits, abuse-prevention controls, and service-protection measures. These limits may apply at the visitor, profile, account, or platform level and may vary by plan.

Growth plans include increased AI chat capacity intended for normal profile visitor activity. Growth plans do not include unlimited, automated, abusive, or excessive use of AI chat features.

Worksona may limit, throttle, temporarily restrict, or disable AI chat access if we detect unusual traffic, automated scraping, attempts to bypass limits, security risk, abuse, excessive usage, or activity that could affect the reliability, cost, or availability of the Service.

12. Free Usage Limits

Free accounts may be subject to usage limits, including monthly visitor chat message limits, generation limits, feature restrictions, or other limits.

We may modify free usage limits at any time.

13. Custom URLs and Slugs

Paid users may be able to claim a custom Worksona URL or slug.

You may not claim a slug that infringes another person's rights, impersonates another person or company, violates a trademark, is misleading, or violates these Terms.

Worksona may reclaim, modify, suspend, or remove any slug at any time if we believe it violates these Terms, violates the rights of others, creates confusion, is inactive, or is otherwise inappropriate.

If your paid subscription ends, your custom slug may be released after a notice period and made available to others.

14. Private Links

Worksona may allow paid users to create private or tailored profile links for specific companies, job descriptions, recruiters, or professional contexts.

You are responsible for the content you include in private links, including job descriptions, company names, customized bios, questions, abilities, and other tailored information.

Private links are not guaranteed to be confidential. Anyone with access to a private link may be able to view it.

15. Feedback

If you provide feedback, ideas, suggestions, or recommendations about Worksona, you grant us the right to use that feedback without restriction or compensation to you.

16. Intellectual Property

The Service, including Worksona's design, software, code, branding, logos, templates, interface, and other materials, is owned by Worksona or its licensors and is protected by intellectual property laws.

These Terms do not give you ownership of Worksona's intellectual property. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by these Terms or applicable law.

17. Copyright Complaints

If you believe content on Worksona infringes your copyright, please contact us at mike@worksona.ai with:

  • A description of the copyrighted work you claim has been infringed.
  • The URL or location of the allegedly infringing material.
  • Your name and contact information.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate.
  • Your physical or electronic signature.

We may remove or disable access to content that we believe may infringe the rights of others.

18. Third-Party Services

Worksona may integrate with or rely on third-party services, including authentication providers, payment processors, hosting providers, storage providers, email providers, analytics providers, AI providers, and other vendors.

Your use of third-party services may be subject to those providers' own terms and policies. Worksona is not responsible for third-party services that we do not control.

19. Service Availability and Changes

We may modify, suspend, discontinue, limit, or remove any part of the Service at any time.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times.

We may release, modify, or remove features, including free or paid features, as we continue developing Worksona.

20. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSONA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.

WORKSONA DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
  • USER CONTENT OR AI OUTPUTS WILL BE ACCURATE OR COMPLETE.
  • A WORKSONA PROFILE WILL RESULT IN EMPLOYMENT, INTERVIEWS, RECRUITER INTEREST, OR BUSINESS OPPORTUNITIES.
  • ENDORSEMENTS, PROFILES, OR VISITOR CHAT CONTENT ARE VERIFIED OR TRUSTWORTHY.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSONA LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSONA'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO WORKSONA IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

22. Indemnification

You agree to defend, indemnify, and hold harmless Worksona LLC and its owners, officers, employees, contractors, agents, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Service.
  • Your User Content.
  • Your published profile.
  • Your endorsements or approval of endorsements.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your violation of another person's rights.

23. Termination

You may stop using the Service at any time.

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, created risk for Worksona or others, failed to pay required fees, or used the Service unlawfully.

Upon termination, your right to use the Service will stop. Certain provisions of these Terms will survive termination, including provisions related to ownership, payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution.

24. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, unless applicable law requires otherwise.

25. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, by email, or by updating the "Last Updated" date above.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
